Terms of service

Governing Law: Chiapas, Mexico
These Terms govern participation in Tokiphon classes and use of Tokiphon services. By enrolling or accessing Tokiphon content, you agree to these Terms in full.
1. Program Admission and Placement
- Placement is determined by an individual assessment.
- Completing an assessment does not guarantee program entry.
- Class availability depends on open spaces in the appropriate level.
- If a class is full, the student may be placed on a waiting list.
- Tokiphon is not equipped to serve students requiring one-on-one or specialized developmental support.
2. Parental Supervision
A parent or responsible adult must remain present and attentive during all lessons. Tokiphon is not responsible for the safety, supervision, or behavior of students.
Parents may not coach or guide the child during instruction and must provide a calm, distraction-free environment.
3. Technology Requirements
Students must join class with:
- A working camera and microphone
- A quiet, well-lit environment
- A stable internet connection
- A computer or tablet (smartphones not recommended)
- A headset or earbuds for clear audio
Tokiphon is not responsible for missed content due to user-side connectivity or device problems.
4. Facial Visibility Requirement
For phonics instruction, full facial visibility is required to observe articulation.
Students must have their eyes, nose, and mouth clearly visible on camera for the entire class.
This requirement is based solely on instructional need. Participation may be paused or removed if visibility cannot be maintained.
5. Class Conduct
Students must:
- Arrive on time and stay for the full session
- Participate respectfully and follow directions
- Avoid eating, chatting, or multitasking
- Remain focused on class content only
Non-class topics are not permitted during sessions.
The teacher may restrict camera, microphone, or participation for safety, behavior, or privacy concerns.
Classes begin and end exactly on time.
Parent discussions require a scheduled private meeting outside class hours.
6. Behavior and Removal
Unacceptable conduct by students or parents may result in immediate removal. Examples include:
- Profanity or vulgar language
- Aggression or threats
- Inappropriate attire or on-camera behavior
- Repeated refusal to participate
Escalation:
- Verbal warning
- Written notice
- Permanent removal with no refund
7. Child Protection
Tokiphon enforces a zero-tolerance policy for abuse or neglect.
Sessions may end immediately if a child appears distressed or unsafe and may be reported if required by law.
8. Media and Copyright
Tokiphon does not record classes.
Recording, screenshots, or redistribution of Tokiphon materials is prohibited.
All curriculum, characters, visuals, and content are protected by copyright.
9. Payments and Attendance
- Payment must be received before participation.
- Subscriptions renew automatically through Shopify.
- It is the parent’s responsibility to cancel before the renewal date.
- Non-payment results in immediate suspension of class access.
10. Liability Disclaimer
Tokiphon provides educational instruction only.
Lessons do not constitute therapy, diagnostic evaluation, or childcare.
Learning outcomes vary by student.
Tokiphon is not liable for indirect, incidental, or consequential damages.
Parents remain responsible for the safety and supervision of their child.
11. Third-Party Services
Tokiphon uses Shopify, PayPal (via Shopify), Printify, and Google Workspace.
Each service maintains its own policies.
Tokiphon is not responsible for outages, data handling, or technical issues caused by these services.
12. Legal Jurisdiction
All disputes related to Tokiphon are governed by Mexican law and resolved exclusively in the courts of Chiapas, Mexico.
Tokiphon is not required to travel internationally for any legal matter.
Disputes are resolved through written or virtual communication.
13. Updates
Tokiphon may revise these Terms at any time. The most current version will always be posted on the Tokiphon website.
